Legacy Design Solutions LLC
Including Legacy Window Art

Last Updated: November 4, 2026

1. Agreement to Terms

These Terms & Conditions (“Terms”) govern the website, products, and professional services offered by Legacy Design Solutions LLC (“Legacy Design Solutions,” “we,” “us,” or “our”), including services marketed under Legacy Window Art.

By purchasing services, signing an agreement incorporating these Terms, or otherwise expressly accepting them, the customer or business (“Client,” “you,” or “your”) agrees to the applicable provisions.

These Terms apply to all services unless otherwise specified. Additional provisions apply to individual services as outlined below.

Project-specific details, pricing, deliverables, and timelines are established through approved proposals, invoices, or service agreements.

In the event of a conflict between these Terms and a signed service agreement, the signed agreement will take precedence.

Legacy Design Solutions reserves the right to update these Terms periodically. Updated terms will apply to future services and transactions with appropriate notice and acceptance where required. Material changes to existing signed agreements require written agreement between the parties unless otherwise permitted by law.

PART I

GENERAL TERMS & CONDITIONS

The following provisions apply to all services offered by Legacy Design Solutions LLC.

2. Services & Project Scope

All services are performed according to the approved proposal, invoice, or service agreement.

Quotes are based on the information provided by the Client and the anticipated scope of work.

Additional services, revisions, design changes, or unexpected requirements outside the approved scope may result in additional charges.

Any additional charges will be communicated and approved before work begins.

Legacy Design Solutions reserves the right to decline projects that are unsafe, unlawful, outside our professional capabilities, or otherwise inappropriate for the requested services.

3. Payments, Deposits & Fees

Payment requirements will be outlined in the applicable proposal or invoice.

Deposits or initial payments may be required to reserve project dates, purchase materials, or begin services.

Remaining balances are due according to the agreed payment schedule.

Late Payments & Fees

Invoices remaining unpaid more than thirty (30) calendar days after their original due date will be subject to a one-time late fee of 10% of the outstanding invoice balance, to the extent permitted by applicable law.

This fee will be assessed only once per invoice and will not compound or recur monthly.

Legacy Design Solutions LLC reserves the right to suspend services or withhold final deliverables for unpaid balances, subject to applicable agreements and legal requirements.

Clients remain responsible for outstanding balances, applicable late fees, and legally recoverable collection costs.

Returned Payments & Bank Fees

If a payment is returned, declined, reversed, or otherwise unsuccessful due to insufficient funds, incorrect payment information, or another issue attributable to the Client, the Client agrees to reimburse Legacy Design Solutions LLC for any actual bank fees, returned payment fees, or payment processing charges incurred as a direct result.

Reimbursement will be limited to documented fees actually incurred and amounts permitted by applicable law.

The original invoice balance remains due, and any applicable late fees may still apply in accordance with these Terms & Conditions.

Legacy Design Solutions LLC reserves the right to require an alternative payment method for future transactions following a returned or unsuccessful payment.

Additional Fees & Expenses

Clients are responsible for approved third-party expenses, including subscriptions, software, hosting, materials, and other external services.

All applicable taxes will be charged as required by law.

4. Cancellations, Refunds & Rescheduling

Clients agree to provide accurate information, necessary materials, access credentials, and timely approvals.

Project timelines depend on reasonable cooperation and communication.

For digital projects, if communication ceases for 14 consecutive calendar days, Legacy Design Solutions may issue written notice requesting a response.

If no response is received within an additional five calendar days, the project may be suspended or terminated.

Clients are responsible for confirming that all submitted content, images, logos, and other materials are legally authorized for use.

We are not responsible for delays caused by incomplete information, unavailable access, delayed approvals, or third-party providers.

5. Client Responsibilities & Communication

Cancellation and refund policies may vary depending on the service purchased.

If a project is canceled, the Client remains responsible for work completed, materials purchased with approval, and approved noncancelable expenses incurred before cancellation.

Any unearned prepaid balance will be refunded unless a separately agreed, legally enforceable nonrefundable fee applies.

For scheduled on-site services, including window painting, Clients are requested to provide at least 48 hours’ notice when canceling or rescheduling.

Late cancellations may result in previously disclosed and agreed charges for preparation, materials, travel, or reserved time.

Legacy Design Solutions may reschedule services due to unsafe conditions, weather, illness, emergencies, or circumstances outside our reasonable control.

If we cancel a project permanently, Clients will receive an appropriate refund for services not performed.

6. Revisions & Project Approval

Included revisions will be outlined in the approved proposal or service agreement.

Additional revisions, major changes to approved concepts, or requests outside the original scope may result in additional fees.

Clients are responsible for reviewing proofs, mockups, designs, and deliverables before final approval.

Once a design or project has been approved, additional changes may be treated as new billable work.

Legacy Design Solutions will correct verified deficiencies within the agreed scope that are reported during the applicable review period.

7. Intellectual Property & Ownership

Clients retain ownership of original materials they provide, including logos, photographs, text, and trademarks.

Upon full payment, Clients receive the ownership or usage rights specified in the applicable service agreement.

Unless expressly included, original working files, editable source files, unused concepts, preliminary sketches, and proprietary design processes remain the property of Legacy Design Solutions.

Third-party fonts, stock images, software, plugins, and licensed materials remain subject to their respective licensing agreements.

Clients may not reproduce, distribute, resell, or commercially use unpaid designs or preliminary concepts without authorization.

8. Confidentiality & Client Information

Legacy Design Solutions respects the confidentiality of nonpublic information shared during projects.

Confidential information will be used only as reasonably necessary to provide contracted services, manage business operations, or comply with legal requirements.

Clients are encouraged to use secure methods when sharing sensitive information or access credentials.

Personal information collected through our website is also governed by our Privacy Policy.

9. Portfolio & Promotional Use

Unless otherwise agreed in writing, Legacy Design Solutions may display completed, publicly available projects in its professional portfolio, website, and marketing materials.

This may include screenshots, photographs, project descriptions, and the Client’s publicly displayed business name or branding.

We will not intentionally disclose confidential information or photograph private residential interiors without permission.

Clients may request restrictions on promotional use before the project begins.

PART II

WEBSITE DEVELOPMENT & MARKETING SERVICES

These provisions apply to website development, website maintenance, SEO, marketing, and related digital services.

10. Website Development

Website development services are provided according to the approved Scope of Work.

Unless otherwise specified, Clients are responsible for providing written content, images, branding materials, and business information.

Legacy Design Solutions may make minor formatting adjustments but is not responsible for independently verifying the accuracy of Client-provided content.

Clients are responsible for reviewing and approving content before publication.

Additional pages, integrations, features, or functionality outside the approved scope may incur additional fees.

11. Hosting, Domains & Third-Party Services

Clients are responsible for managing, maintaining, and renewing any website-related products or services held within their own accounts. This includes, but is not limited to, domain registrations, website hosting, SSL certificates, website security, premium plugins, and third-party subscriptions.

For products or services managed through Legacy Design Solutions LLC’s accounts, management, renewal responsibilities, billing arrangements, and any associated fees will be determined by the applicable service agreement or invoice.

Clients acknowledge that website-related products may be maintained across multiple accounts or providers. Legacy Design Solutions LLC is not responsible for the expiration, cancellation, suspension, or interruption of products maintained within Client-controlled accounts, unless management of those products is expressly included in a separate service agreement.

Third-party services remain subject to their respective providers’ terms, pricing, availability, and renewal policies.

12. Website Maintenance, Security & Backups

Clients are responsible for maintaining their website hosting, security, software updates, and backups for services held within their own accounts, unless these responsibilities are expressly included in a separate maintenance agreement with Legacy Design Solutions LLC.

For services hosted or managed through Legacy Design Solutions LLC’s accounts, maintenance, security, updates, and backup responsibilities will be determined by the applicable service agreement and the level of service purchased.

Website hosting alone does not automatically include ongoing website maintenance, software updates, security monitoring, or backup services.

13. SEO & Marketing Services

Legacy Design Solutions provides marketing and SEO services using reasonable professional care and accepted industry practices.

However, search engine rankings, website traffic, leads, engagement, conversions, and sales depend on factors outside our control.

We do not guarantee specific rankings, traffic levels, advertising performance, or financial results.

Clients remain responsible for approving marketing content and ensuring their advertising claims, promotions, and business practices comply with applicable laws and industry regulations.

Advertising budgets, platform fees, and third-party marketing expenses are separate from service fees unless otherwise specified.

14. Recurring Digital Services

Recurring services, including website maintenance, SEO, and marketing retainers, are billed according to the agreed schedule.

Clients may cancel recurring services according to the applicable service agreement.

Unless otherwise agreed, cancellation does not eliminate outstanding charges for services already performed or approved expenses incurred.

Unused services, prepaid balances, and renewal obligations will be handled according to the applicable agreement and law.

PART III

PART III — GRAPHIC DESIGN & BRANDING

These provisions apply to logos, branding, digital artwork, print design, and related creative services.

15. Custom Artwork & Design

Custom artwork is created according to the approved design concept and project scope.

Initial concepts, sketches, mockups, and digital previews are intended for review and may differ from final deliverables.

Included revisions will be specified in the proposal.

Additional revisions, major design changes, or requests made after approval may incur additional fees.

16. Digital Artwork & AI-Assisted Concepts

Legacy Design Solutions may use digital design tools, including AI-assisted technology, for concept development, visual references, and mockups when appropriate.

AI-generated or AI-assisted concepts are intended to communicate creative direction and may not represent the exact final deliverable.

Final artwork may differ in proportions, colors, lettering, textures, composition, or other artistic details.

Use of AI-assisted tools does not guarantee that generated elements are unique, copyrightable, or available for exclusive ownership.

Any specific requirements regarding original hand-drawn artwork, AI restrictions, or exclusive rights must be agreed upon before work begins.

17. Printing & Production

Legacy Design Solutions LLC offers in-house printing and production services, including custom stickers, decals, labels, and other printed materials.

Artwork & File Requirements

Clients are responsible for providing artwork in a suitable format and resolution for printing.

Low-resolution images, improperly formatted files, and artwork requiring adjustments may result in additional design or setup fees.

Legacy Design Solutions LLC will notify Clients of any identified file concerns before production. However, Clients remain responsible for the accuracy and quality of supplied artwork, including spelling, dimensions, and design elements.

Proof Approval & Production

Digital proofs may be provided for Client approval before production.

Once a proof is approved, the Client authorizes production based on the approved design, dimensions, quantities, and materials.

Changes requested after production begins may result in additional charges.

Legacy Design Solutions LLC is not responsible for errors present in artwork or proofs approved by the Client, except where the final product does not reasonably conform to the approved specifications.

Color & Printing Variations

Printed colors may differ from digital previews due to monitor settings, color profiles, printing equipment, ink, material finishes, and lighting conditions.

Minor variations in color, print placement, contour cutting, and finished dimensions are normal manufacturing tolerances and are not automatically considered defects.

Exact color matching is not guaranteed unless specifically agreed upon in writing.

Materials, Durability & Application

Sticker and decal durability varies depending on the selected materials, lamination, installation methods, environmental exposure, and intended use.

Clients are responsible for selecting materials appropriate for their intended application based on the product information provided.

Unless expressly stated, Legacy Design Solutions LLC does not guarantee that printed materials are waterproof, UV-resistant, scratch-resistant, or suitable for prolonged outdoor exposure.

Improper installation, surface preparation, cleaning methods, and environmental conditions may affect adhesion and longevity.

Custom Orders, Cancellations & Refunds

Because custom printed products are produced specifically for each Client, orders generally cannot be canceled once production has begun.

Clients remain responsible for completed work, materials consumed, and approved production expenses.

Refunds or credits for canceled orders will be determined by the amount of work completed, applicable agreements, and legal requirements.

Custom printed products are not eligible for returns solely because of a change of mind after production, except where required by law.

Defective Products & Order Issues

Clients should inspect their orders upon receipt and report any printing defects, incorrect quantities, or production errors within seven (7) calendar days when reasonably possible.

Legacy Design Solutions LLC will review reported concerns and may request photographs or other documentation.

For verified production errors attributable to Legacy Design Solutions LLC, an appropriate remedy may include correction, replacement, reprinting, or a refund, depending on the circumstances and applicable law.

This policy does not limit any nonwaivable consumer rights.

Client-Provided Artwork & Intellectual Property

Clients confirm that they own or have obtained the necessary permissions to reproduce all artwork, logos, photographs, trademarks, and other materials submitted for printing.

Legacy Design Solutions LLC reserves the right to decline printing requests involving suspected infringement, unlawful content, or materials that cannot legally be reproduced.

Clients are responsible for claims arising from unauthorized use of materials they supply, subject to applicable law.

PART IV —

LEGACY WINDOW ART

These provisions apply to window painting, storefront artwork, seasonal displays, chalkboard art, and other on-site painting services offered by Legacy Design Solutions LLC under Legacy Window Art.

18. Design Concepts & AI Mockups

Digital mockups, sketches, AI-generated previews, and other visual concepts are intended to communicate the overall design direction, colors, placement, and artistic style.

Clients acknowledge that AI-generated or digital previews are visual references and are not guaranteed to be identical to the final hand-painted artwork.

Hand-painted designs may differ in lettering, linework, proportions, shading, opacity, color, and placement.

These variations occur naturally due to painting techniques, materials, window dimensions, lighting, and the artist’s interpretation.

Legacy Window Art will make reasonable efforts to follow the approved design concept.

Minor artistic variations are not considered defects. Material deviations from the agreed design or workmanship deficiencies will be addressed through reasonable corrections.

19. Hand-Painted Artwork & Artistic Differences

All hand-painted artwork is individually created and may contain natural variations, including visible brushstrokes, minor line irregularities, differences in paint coverage, and variations in color.

Clients acknowledge that hand-painted artwork cannot be reproduced with the same precision as printed or digitally generated graphics.

These natural artistic characteristics are part of the handmade process.

Requests for exact reproduction of digital imagery, photographs, or AI-generated artwork must be discussed before project approval.

20. Window Condition & Glass Safety

Clients are responsible for disclosing known concerns regarding the surfaces to be painted, including:

  • Existing cracks, chips, scratches, or damage.

  • Window tinting, films, coatings, or specialty glass.

  • Previous paint, adhesives, or surface treatments.

  • Known thermal stress issues or manufacturer restrictions.

  • Building or property management requirements.

Certain paint colors, large solid areas, and coverage patterns may affect heat absorption on glass exposed to direct sunlight.

This may increase the risk of thermal stress, particularly in hot climates such as Arizona.

Legacy Window Art may recommend design adjustments, reduced paint coverage, or alternative placement to reduce potential risks.

No painted-glass application can be guaranteed free from thermal stress or breakage risk.

Clients are encouraged to consult their window manufacturer, installer, or property manager regarding surface suitability and warranty restrictions.

Legacy Window Art reserves the right to decline work on surfaces considered unsuitable or unsafe.

21. Property Access & Preparation

Clients agree to provide safe, reasonable access to the painting area during scheduled service hours.

Work areas must be reasonably accessible and free from obstructions.

Clients are responsible for obtaining required permission from property owners, landlords, management companies, or HOAs before work begins.

Clients should identify fragile surfaces, preexisting damage, and other relevant property concerns before painting.

Legacy Window Art may postpone work when conditions are unsafe or access is inadequate.

22. Weather & Environmental Conditions

Exterior painting is subject to weather and environmental conditions.

Extreme heat, rain, wind, dust, humidity, and other factors may affect paint application, drying, adhesion, and durability.

Legacy Window Art reserves the right to reschedule painting when conditions are unsuitable.

Clients acknowledge that environmental exposure may affect the appearance and lifespan of exterior artwork.

23. Artwork Durability & Maintenance

Window painting is generally intended as temporary or seasonal artwork unless otherwise specified.

Artwork lifespan varies based on paint materials, sunlight exposure, weather, cleaning methods, and physical contact.

Clients should avoid pressure washing, abrasive cleaning, scraping, or harsh chemicals on painted surfaces.

Legacy Window Art does not guarantee a specific lifespan unless expressly stated in writing.

Normal fading, weathering, or damage caused by improper cleaning or third-party interference is not considered a workmanship defect.

24. Artwork Removal

Paint removal is not included unless specifically stated in the approved proposal or invoice.

Removal services may be scheduled separately for an additional fee.

Clients who choose to remove artwork themselves are responsible for their removal methods.

Improper removal techniques may damage glass, coatings, tint, frames, or surrounding surfaces.

Legacy Window Art will exercise reasonable care when performing contracted removal services but cannot guarantee damage-free removal where preexisting defects, incompatible coatings, or other conditions make the surface unsuitable.

25. Changes During Painting

Once painting begins, major changes to the approved design may require additional labor, materials, and scheduling adjustments.

Requests to relocate, resize, repaint, or substantially redesign completed portions of the artwork may incur additional fees.

Any additional charges will be communicated and approved before extra work begins.

27. Recurring & Seasonal Window Painting

Legacy Window Art will take reasonable precautions to protect surrounding property and perform painting services with appropriate professional care.

Clients are responsible for disclosing known surface defects, restrictions, and conditions that may affect the work.

Legacy Window Art is responsible for damage to the extent caused by its negligence or failure to exercise reasonable care, subject to applicable law and enforceable contractual limitations.

We are not responsible for preexisting damage or damage caused solely by unrelated third parties or circumstances outside our reasonable control.

26. Property Damage & Liability

Clients may arrange recurring window painting services, including monthly, seasonal, or holiday designs.

Recurring services will be scheduled according to the agreed proposal or service arrangement.

Each design may require separate approval unless a recurring creative plan has been agreed upon.

Pricing, removal services, materials, and scheduling requirements will be specified in the applicable agreement.

Clients should provide reasonable advance notice when requesting changes or cancellations.

Recurring arrangements do not automatically include complimentary removal, design changes, or additional painting unless expressly stated.

28. Chalkboard & Specialty Surface Artwork

Chalkboard artwork, menu boards, and other specialty surfaces may require different materials, preparation techniques, and maintenance procedures.

Clients must disclose existing coatings, finishes, surface damage, and special cleaning requirements.

Durability and removability may vary depending on the materials and surface.

Changes to completed menu items, lettering, pricing, or artwork are considered additional services unless otherwise agreed.

PART V —

LEGAL & WEBSITE POLICIES

29. Limitation of Liability

Legacy Design Solutions agrees to exercise reasonable professional care in performing contracted services.

To the maximum extent permitted by applicable law, neither party shall be liable for indirect, incidental, special, consequential, or punitive damages arising from the services, except where prohibited by law.

Any applicable monetary limitation of liability will be governed by the signed service agreement or other expressly accepted contractual terms.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

30. Indemnification

To the extent permitted by applicable law, Clients agree to indemnify Legacy Design Solutions against third-party claims, losses, and reasonable legal expenses arising from Client-provided materials that infringe third-party rights, Client’s unlawful instructions, or Client’s material breach of these Terms.

This obligation does not apply to the extent a claim results from Legacy Design Solutions’ negligence, willful misconduct, or breach of its own obligations.

31. Website Use & Prohibited Activities

Visitors may not use our website for unlawful activities, unauthorized access, malicious software distribution, fraud, harassment, or interference with website functionality.

Website content, branding, and intellectual property may not be reproduced or commercially exploited without authorization, except as permitted by law.

We reserve the right to restrict access or take appropriate action in response to unlawful activity or violations of these Terms.

32. Electronic Communications & Signatures

Clients consent to conducting business electronically where permitted by law.

Electronic proposals, invoices, agreements, signatures, and communications may be used to document transactions, approvals, and project requirements.

Electronic signatures are intended to carry the same legal effect as handwritten signatures where applicable law permits.

33. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

If a dispute arises, both parties agree to make reasonable, good-faith efforts to resolve the matter through written communication before pursuing formal legal remedies.

Nothing in these Terms limits rights or remedies that cannot legally be waived.

34. General Provisions

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision does not constitute a waiver of the right to enforce it later.

These Terms, together with applicable signed agreements, approved proposals, and incorporated policies, govern the services provided.
